Terms of purchase
Introduction:
The present General Terms and Conditions (hereinafterreferredtoas "GTC") areoperated by Nero BauManagement Ltd. (registered office: 9752 Kenéz, Kossuth Lajos utca 29.; company registration number: 18-09-112794; registered court: Court of Registration of the Szombathelyi General Court; tax number: 25485837-2-18; e-mail: nerobau@freemail.hu (hereinafterreferredtoas "Service Provider")).com (hereinafter referred to as the "Webshop") (hereinafter referred to as the "Webshop") (hereinafter referred to as the "Service"), the terms and conditions of use of the services and intellectual property products (hereinafter referred to as the "Service") available to the Customer (hereinafter referred to as the "Customer" or "User" or "Buyer"). Service Provider and Customer are hereinafter collectively referred to as the "Parties".
The GTC apply to all legal relations between the Service Provider and itsCustomersorBuyers in connectionwith the use of the Services provided on the Webshop.
Nero Bau Management Ltd., as the operator of the workeujobs.com website, reserves the right to unilaterally modify these General Terms and Conditions. The Service Provider may inform its Customers of such modification by means of a short notice, which may be included in the dedicated interface of the Webshop, in the newsletter sent by the Service Provider or in the e-mail notification sent to all Customers at the e-mail address provided in their account. In such cases, an amended version of the General Terms and Conditions will be displayed on the Site, the content of the General Terms and Conditions should be checked from time to time on the Webshop. The User/Customer has the right to object to the Terms and Conditions as soon as they are displayed on the Webshop.
The following terms shall have the following meanings in these GTC:
User: a natural or legal person over the age of 18 who accesses the content of workeujobs.com;
Customer: the User who registers on workeujobs.com, has a user account (hereinafter: My Account) - thereby accepting the Terms and Conditions of workeujobs.com. In case of natural persons, registration is subject to the age of 18 years;
Buyer: theCustomerwho has placed an order through the My Account on workeujobs.com. In the case of a natural person, you must be at least 18 years of age;
My Account: the Customer can create a My Account by registering on the Webshop and entering his/her name, e-mail address and password. IftheUserplaces an orderon the Webshop without using a My Account, the Customer creates a My Account for the Service Provider with the data provided during the ordering process. The My Account contains the data and information provided by the Customer during registration and when placing the order(s), as well as the order number and relevant documents related to the order. The concluded contract will not be filed, but it will be retrievable by our Company, upon request, on the basis of the date of the GTCacceptedbytheBuyeratthetime of placing the order. The User is required to provide true data during registration and the Customer is required to provide true data when placing the order. The User is responsible for the accuracy, completeness and timeliness of the data provided by him/her. If the Service Provider becomes aware that the data provided by the User/Customer (also) contains elements that are not real, the Service Provider is entitled to restrict the Customer's access to his/her own account or to exclude the Customer from using workeujobs.com. The Service Provider is also entitled to restrict the Customer's access to his/her own account or to exclude the Customer from using the Webshop in case the Customer misuses the workeujobs.com platform or its services;
Website: the webshop is located at www.workeujobs.com and its subpages;
Services and Intellectual Products: any service or intellectual product offered for sale by the Service Provider, which is indicated/appears on the Website and for which the Customer may place an order;
Contract: a contract is concluded between the Service Providerand theBuyerforthesale/purchase of the services displayed on the Website, as set out in these GTC, without the simultaneous physical presence of the Service Providerand theBuyer. The language of the contract is Hungarian/English. The contract does not constitute a written contract;
Newsletter: a commercial message or communication sent periodically by the Service Provider to Users subscribed to the newsletter service by electronic means (e-mail, SMS), which informs and provides information about changes/news concerning workeujobs.com, Services displayed on workeujobs.com and/or promotions and discounts organised/undertaken by the Service Provider in a given period;
Order: the Buyer makes a purchase offer to the Service Provider for one or more Services on the Website, which the Service Provider accepts or rejects in an e-mail confirmation; theBuyer is entitledto modify or cancel the Contract through his/her Account until the Order is fulfilled.
- Subject of the contract:

- The services provided by the Service Provider do not constitute full recruitment services. The Service Provider does not guarantee the success or durability of the employment relationships resulting from the CVs forwarded.
2. Contract and use services:
- The contract between the Customer and the Service Provider is concluded in writing or electronically after the Customer accepts the Service Provider's offer and these GTC.
- In order to use the Services, the Customer must provide the Service Provider with accurate and up-to-date information. The Service Provider shall not be liable for any damages resulting from incorrect or incomplete information provided by the Customer.
3. To order
- My account:
- In order to place an Order on the Website, the User/Customer must create an account on the Website by entering his/her name, e-mail address and password.
- If the User places an Order on workeujobs.com without using a Personal Account, the User creates a Personal Account for the Service Provider with the data provided during the Order.
- Place an order:
- Through theWebshop, theCustomer/Buyermayplace an Order electronically by adding the selected Service(s) to the shopping cart, providing the billing information required to complete the Order and selecting the payment method. Placing the Service(s) in the shopping basket does not constitute finalisation of the Order.
- After accepting these GTC, the Customer can finalise the Order (offer) by clicking on the Order button.
- By finalizing theOrder, theCustomer/Buyerdeclaresthatthe data provided by him/her for the purchase are true and agrees to their use and processing by the Service Provider for the purpose of fulfilling the Order, in particular, in order to contact him/her, if necessary, by any of the contact details (email or telephone) provided. By finalising the Order, the Customer undertakes to pay the Order in the manner of payment indicated by him, failing which the Seller may refuse to fulfil the Order.
- The Buyer is entitledto amend the Contract until the Order is fulfilled.
- Confirmation of order, conclusion of contract:
- The placing of the OrderbytheBuyerconstitutes an offer, which, upon receipt by the Service Provider, results in a binding offer on the part of theBuyer. Placing an Order does not result in the conclusion of a contract between the Service Providerand theBuyer. After placing the Order, the automatic system message senttotheBuyerby e-mail shall be deemed to be the confirmation of the Order and the receipt of the offer by the Service Provider, and shall therefore be informative and shall not constitute confirmation of the Order by the Service Provider (first system message).
If the above confirmation (first system message) is not receivedbytheBuyerwithin a reasonable period of time from the date of sendingtheBuyerorder, dependingon the nature of the service, but no later than 48 hours, the Customer is released from the obligation to make an offer or a contractual obligation.
The Contract between the Service Providerand theBuyeris concluded - theoffermadebytheBuyeris acceptedby the Service Provider - whentheBuyerreceivestheconfirmation of the acceptance of the Order (second confirmation message) from the Service Provider by e-mail.
If the Service Provider cancels or rejects the Order, the contract shall not be concluded. The Order and its confirmation (or rejection) shall be deemed to have been received by the Service ProviderortheBuyer, asthecase may be, when it becomes available to the other party.
- The order shall be deemed to be a contract concluded by electronic means, which shall be governed by Act V of 2013 on the Civil Code, Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services.
- By placing an order in theWebshop, theCustomer/Buyeracknowledgesthatsales through the Website are made exclusively to end users. No commercial resale or resale of Services purchased through the Website is permitted. By accepting these Terms and Conditions, the Customer/Buyerirrevocably acknowledges this fact and expressly waives any and all claims for damages or other claims in connection therewith. Therefore, iftheCustomer/Buyerpurchases and sellsfor commercial resale or resale in breach of this clause and suffers any damage or material loss (including, but not limited to, liquidated damages) as a result, he/she shall bear such damage himself/herself, given that the liability of the Service Provider in this respect is excluded in its entirety under this clause. This Clause shall apply to the Parties in respect of both liability for breach of contract and liability for non-contractual damages. For the avoidance of doubt, the Parties agree that this Clause shall apply only and exclusively to claims for damages and other claims arising out of commercial resale or resale and shall be without prejudice to any other claims for damages of the Parties.
4. Payment terms, billing:

- Afterpayment, theBuyerwillreceive an e-mail with a link to download the intellectual property or the information necessary to use the service.
- The Service Provider shall issue an invoicetotheBuyerforthe Products ordered, and theBuyershall be obligedto forward all data and information necessary for the issuance of the invoice in accordance with the legislation in force.
- For each recorded Order, the invoice will indicate the purchase price of the Services to be purchased, the payment method and the payment deadline. The Supplier shall issue an invoice for the Services ordered and delivered, in accordance with the legislation in force. It is the responsibility of theBuyertorecordallthedata relating to him/her on the invoice issued, in accordance with the law. Failure to do so, or incomplete or incorrect recording, shall not oblige the Service Provider to issue a new invoice.
- The Service Provider shall provide the invoice for the Services soldtotheBuyerprimarilybyelectronic means. The issued invoice is available in electronic form from the Customer's My Account, or in the form of an electronic message (e-mail), the link to the access is sent to the e-mail address specified in the My Account.
5. Performance conditions:
- The Services are sent electronically to the e-mail address providedbytheBuyer.
- The date and method of performance of the services will be agreedwiththeBuyerin advance.
6. Responsibility:
- The Service Provider's liability shall be limited to the services specified in the contract. The Service Provider shall not be liable in connection with any agreement, employment relationship or termination of employment between the Employing Customer and the potential Employing Customer.
- It is the Customer's sole responsibility to carefully review the documents transmitted by the Service Provider and to act on his/her own judgment.
7. Right of withdrawal:
- The Buyer, who is a consumer, has the right to withdraw from the contract within 14 days from the receipt of the Service, as set out below, in accordance with the provisions of Government Decree 45/2014 (26.II.) on the detailed rules of contracts between consumers and businesses (hereinafter: Government Decree).
- Under the GovernmentDecree, theBuyer(if he/she is a consumer) has the right of withdrawal. The Buyermayexercisethisright in all cases, with some exceptions, without giving reasons.
The above shall not affect the right of withdrawal of the Customer/Consumer who is a consumer, which may be exercised by the Customer/Consumer in the period between the date of conclusion of the contract and the date of receipt/acceptance of the Service.
- The Consumer may exercise his right of withdrawal by using the model declaration provided in the Government Regulation or by sending a clear declaration to the Service Provider by e-mail or by post.
- The right to withdraw from the Contract may not be exercised in the case of a contract for the provision of the Service after the Service has been performed in its entirety, if the Service Provider has commenced performance with the express prior consent of theBuyerand theBuyerhas acknowledgedthat he/shewill lose the right to withdraw from the Contract after the Service has been performed in its entirety.
8. Warranty and guarantee:
- The Service Provider warrants that the intellectual products and services it offers comply with the applicable legal requirements and the parameters set out in the description.
- The Service Provider does not warrant that the Services will result in the Customer being able to establish successful business agreements or employment relationships. The Customer shall use its own discretion based on the information provided by the Service Provider.
- The Service Provider does not provide any warranty for its services, unless required by applicable law or expressly stated in an individual contract. In the case of a guarantee, the details of the guarantee shall be specified in the individual contract.
9. Confidentiality:
- The Service Provider shall treat any information providedbytheBuyer/Customertothe Service Provider as confidential and may only share it with third parties in accordance with these GTC.
- The Buyer/Customer shall not make any public statements to third parties in relation to the Order/Contract without the prior written consent of the Service Provider.
10. Data protection:
- The Service Provider shall process the personal data provided by the Customer in accordance with the applicable data protection legislation.
- The detailed Privacy Policy is available on the Webshop's website.
11. Dispute resolution:
- The parties shall attempt to settle any disputes arising from the contract by amicable negotiation.
- If the negotiations do not lead to a result, the court competent for the Service Provider's registered office shall have exclusive jurisdiction to settle the dispute.
12. Final provisions:
- In matters not regulated in these GTC, the provisions of the Hungarian legislation in force shall prevail.
- These GTC constitute an integral part of the contract between the Service Provider and the Customer and shall be interpreted in conjunction with the provisions of thecontract.

V. Advertising and marketing messages (e-DM)
